General Terms and Conditions
The General Terms and Conditions of the Fiziosan d.o.o. online store, Ptujska ulica 19, 1000 Ljubljana, are drawn up in accordance with the Consumer Protection Act (ZVPot), the Electronic Commerce on the Market Act (ZEPT), and the Personal Data Protection Act (ZVOP-1).
The General Terms and Conditions regulate the operation of the online store, the rights of users, and the business relationship between the provider and the customer.
By placing an order to purchase selected products on our website, you agree to the General Terms and Conditions of cooperation and purchase.
Terms of Purchase on www.fiziosan.si
The customer confirms that they have read the full text of the General Terms and Conditions of the online store on www.fiziosan.si (hereinafter: the Terms) and agree to them.
Online sales on www.fiziosan.si are operated by Fiziosan d.o.o., Ptujska ulica 19, 1000 Ljubljana.
Ordering
Online purchases in the fiziosan.si online store can be made as a guest, in which case the customer's data is recorded in our database of completed purchases. In both cases, information relating to the user's purchase is recorded in our database. The protection of personal data is described below in a separate section.
When browsing the offer, the user selects the “Add to Cart” option next to the selected products. The selected products are collected in the shopping cart (icon in the upper right corner), which the user can check at any time and edit the products contained therein (change the quantity and/or remove products from the list). The user continues the ordering process by clicking the “Checkout” button, where they review the list of selected products. At checkout, the user completes the entire purchase process.
After the user confirms and submits the order, Fiziosan d.o.o. sends an electronic order confirmation.
Before confirming the order, Fiziosan d.o.o. reviews the order and reserves the right to reject it if the product is no longer in stock or if there are obviously incorrect prices that may arise due to errors in automated data transfers. The customer will be informed of this as soon as possible. In case of uncertainty, verification of information, or to ensure accurate delivery, the company may contact the customer by telephone using the number entered during checkout.
The sales contract between Fiziosan d.o.o. and the customer is concluded when the seller confirms the order. From that moment onwards, all prices and other conditions are fixed and binding on both Fiziosan d.o.o. and the customer. The customer is the person whose details are provided when placing the order. Customer details cannot be changed after the order has been submitted. By placing an order, the customer guarantees the accuracy of the information provided and confirms the Terms and Conditions, irrevocably and exclusively accepting them as an integral part of their order.
The confirmed order is stored electronically at the registered office of Fiziosan d.o.o., Ptujska ulica 19, 1000 Ljubljana.
The customer may obtain a copy of the order by sending a request by email to info@fiziosan.si.
Any costs associated with the use of communication services when placing an order do not differ from the standard tariff.
Material Defects, Complaints, Service and Warranty
In accordance with the Consumer Protection Act (ZVPot), Fiziosan d.o.o. is liable for material defects in goods.
The customer must notify Fiziosan d.o.o. of any material defect, together with a detailed description of the defect, within two days of discovering the defect and must simultaneously allow the goods to be inspected. Fiziosan d.o.o. is not liable for material defects in goods that become apparent after the statutory period from the date of receipt of the goods has expired.
The right to assert a material defect in goods is governed in greater detail by the provisions of the Consumer Protection Act.
At Fiziosan d.o.o., we understand the importance of complaints and therefore strive to resolve them as quickly as possible, to the mutual satisfaction of both parties and in accordance with applicable legislation.
Complaints (return of incorrect, incomplete, or damaged goods) should be reported by email to info@fiziosan.si.
The consumer must then return the goods to the company no later than 10 days after providing written notice of withdrawal from the purchase, bearing the direct costs of the return themselves. Products must be unused and undamaged. A copy of the order must be enclosed. The customer bears the cost of returning the goods. The provider will refund the full purchase price (purchase price including delivery costs) as soon as possible, but no later than 20 days after receiving the consumer's notice of withdrawal from the purchase.
Prices
All prices are displayed in EUR and include VAT, which is clearly stated on the final invoice. Prices and other benefits (discounts, etc.) apply at the time the order is placed and have no predetermined validity period. The stated prices apply only to purchases made through the online store www.fiziosan.si and to the payment methods listed below under the stated conditions.
Fiziosan d.o.o. reserves the right to change the prices of its product range on a daily basis without prior notice.
If the price information is incorrect or the price changes during order processing, Fiziosan d.o.o. will allow the customer to withdraw from the purchase.
Payment Methods
The following payment methods are available in the online store www.fiziosan.si:
Cash on delivery (the customer pays the cash-on-delivery fee);
Pro forma invoice** – after completing the purchase, payment details will be sent to the email address provided, based on which the customer makes the payment;
Payment by debit or credit card.
If the customer pays by credit card online and subsequently cancels the order or changes the payment method, they should notify us at info@fiziosan.si so that the card payment can be credited or the purchase price refunded.
**After payment of the pro forma invoice has been received, the order proceeds to the processing stage.
When selecting payment by “pro forma invoice”, you will be redirected to a page containing the payment details: payment amount, bank account, reference number and payment purpose. In this case, you will pay for the ordered goods using a standard UPN payment order (form) at a bank, post office, or through your online banking service. After making the payment, you may send proof of payment to info@fiziosan.si to speed up the processing of your order. The pro forma invoice must be paid within 3 working days at the latest; otherwise, Fiziosan d.o.o. will cancel the order.
Payment to the bank account of Fiziosan d.o.o. is made based on the payment details provided to the user when selecting the “Pro forma invoice” payment method.
Delivery and Collection
Ordered goods that are in stock will be dispatched within a maximum of 3 working days after receipt of the order, or after receipt of payment in the case of a pro forma invoice, unless otherwise stated. Delivery times may be extended due to public holidays or weekends, and we kindly ask for your understanding. If the ordered goods are currently out of stock, we will notify you by email or telephone.
Delivery is carried out in cooperation with Pošta Slovenije or another contracted delivery service. If you are not at home at the time of delivery, you may collect the ordered products in accordance with the delivery service's rules.
Delivery Costs and Invoice
The customer bears the costs of packaging and delivery. The cost is calculated according to the applicable price list and the weight of the shipment. The shipping cost will be calculated and displayed separately before the order is submitted. VAT is included in the delivery price.
Packaging and delivery costs are charged during the purchase process in the online store www.fiziosan.si.
The customer receives the goods at the specified address in accordance with the delivery service's rules.
Upon receipt of the delivered goods, the customer will also receive the original invoice containing all relevant information and issued in accordance with the sales conditions published on this page and confirmed when the order was placed.
After dispatching the ordered products, Fiziosan d.o.o. also sends the customer the invoice electronically to the customer's email address or encloses it with the shipment.
In the case of personal collection at a collection point, the customer receives a printed invoice for the purchased products upon collection.
The invoice itemizes the price and all costs associated with the purchase.
The customer is obliged to check the accuracy of the information before submitting the order, as Fiziosan.si will not consider subsequent objections concerning the accuracy of issued invoices.
Right of Withdrawal
The consumer has the right to withdraw from the contract without stating a reason within 14 days of receiving the goods and must send written notice of withdrawal within this period. This applies exclusively to individuals purchasing an item for purposes outside their professional or commercial activities.
To exercise the right of withdrawal, the consumer must notify Fiziosan d.o.o., Ptujska ulica 19, 1000 Ljubljana, email: info@fiziosan.si, by means of an unequivocal statement of their decision to withdraw from the contract (in writing by post, fax, or email). For this purpose, the consumer may use the model withdrawal form, which is available upon request by email.
In the event of withdrawal from the contract, the consumer bears the direct costs of returning the goods.
If the consumer has already received the goods and withdraws from the contract, the goods must be returned to Fiziosan d.o.o. as soon as possible and no later than 14 days from the date the withdrawal notice was sent. The goods must be returned undamaged, in the same quantity, and in the original, undamaged packaging, together with all accompanying documentation and a copy of the original invoice.
The company will refund the purchase price within 14 days of receiving the withdrawal notice. The company has the right to withhold the refund until the returned goods have been received or until the consumer provides proof that the goods have been sent back.
The right to a refund in cases involving warranty claims and material defects is governed in greater detail by the provisions of the Consumer Protection Act.
Complaints and Disputes
Fiziosan d.o.o. complies with applicable consumer protection legislation and will make every reasonable effort to ensure an effective complaint-handling system.

The complaint-handling procedure is confidential.
Within five working days, Fiziosan d.o.o. will confirm receipt of the complaint and inform the customer of the expected duration of the complaint-handling process and keep them informed of its progress.
Any disputes arising from the use of the online store www.fiziosan.si between the customer and Fiziosan d.o.o. will primarily be resolved amicably. If this is not possible, the court with subject-matter jurisdiction in Maribor shall have jurisdiction to resolve the dispute.
Fiziosan d.o.o. does not recognize any provider of alternative dispute resolution as competent to resolve a consumer dispute that the consumer may initiate under the Act on Out-of-Court Resolution of Consumer Disputes.
Personal Data Protection
By entering into a purchase contract, you consent to the storage and use of your personal data exclusively for the purposes of fulfilling the order (sending informational materials, offers, invoices, notifications about new products and other necessary communication).
Fiziosan d.o.o. undertakes to process all personal data obtained in accordance with the Personal Data Protection Act, including appropriate protection against loss, destruction, falsification, manipulation, unauthorized access, or disclosure by third parties. Despite appropriate technical and organizational procedures for protecting the data we collect, Fiziosan d.o.o. cannot completely exclude the possibility of data misuse, as the internet remains an unpredictable medium despite security measures and secure communication protocols.
The user is also responsible for protecting their personal data by ensuring the security of their username and password and using appropriate, original computer equipment that is updated and protected by antivirus software.
For business purposes, Fiziosan d.o.o. collects the following user data: first and last name, address and place of residence, email address, contact telephone number, and other information entered by users in forms on www.fiziosan.si. Fiziosan d.o.o. is not responsible for the accuracy of data entered by users.
Cookies and Their Use
The amended Electronic Communications Act (Official Gazette No. 109/2012; hereinafter ZEKom-1), which entered into force at the beginning of 2013, introduced new rules regarding the use of cookies and similar technologies for storing information or accessing information stored on a user's computer or mobile device. Cookies are not new; the law only affected the way website users are informed about their use and how their consent is obtained.
